Who these terms are with

These Public Beta Terms are an agreement between you and PixelSunset LLC, the operator of Smart Breeze. In these terms, references to Smart Breeze as the party running the beta or making a program commitment mean PixelSunset LLC. Questions about these terms can be sent to support@smartbreeze.app.

Scope

The public beta DMG offers physical fan control only on the exact Mac16,7 model. On every other Apple-silicon Mac, fan writes remain disabled in the public build unless Smart Breeze provides a separately signed qualification build for that exact model. Build 24 continues read-only temperature discovery when FNum is unavailable and exposes discovered readings in a sensor explorer, but thermal availability remains model-specific and the M5 MacBook Air path awaits physical verification. The current public beta DMG does not support Intel Macs.

Version 0.3.13 has no automatic updater. Updates, if offered during beta, require a newly signed and notarized DMG and manual replacement of the Applications copy.

Hardware testing program

Owners of fan-equipped Apple-silicon Macs may apply for exact-model fan-control qualification, and owners of fanless Apple-silicon Macs may apply for exact-model sensor-compatibility testing. An application and its checkbox acknowledgements remain unverified until the Smart Breeze team receives a reply from the submitted email address. No test assignment or model-specific build is issued before that confirmation. Applying does not guarantee selection or enable fan control. Access may be delayed, limited, or withdrawn when a model lacks enough coverage or produces an unexplained result.

A fanless sensor-compatibility assignment is monitoring-only. It may test model identification, available CPU, GPU, memory, battery, and hottest-temperature readings, refresh behavior, and sleep or wake, but it never enables or tests fan control and does not require the privileged fan helper. A fan-control assignment begins with read-only preflight and advances to a separately signed exact-model build only in the sequence Smart Breeze specifies.

Selected testers must use only the public or signed model-specific build named in their assignment, follow the provided test sequence, keep current backups, and stop when the assigned plan or Smart Breeze’s safety instructions require it. Model-specific builds may not be modified, redistributed, or used to bypass Smart Breeze’s hardware allowlist. Any unexplained ownership loss, failed System handoff, recurring required reconnect, helper-authentication failure, incorrect fan readback, or missing or inconsistent monitoring result must be reported and may pause that model’s cohort while it is investigated.

Complimentary tester license

An applicant becomes an Accepted Tester only after verifying the submitted email address and receiving written cohort acceptance from Smart Breeze that identifies the exact model, required test plan, expected time, and completion date. Applying, joining the waitlist, verifying an email address, or receiving a test build does not by itself earn the benefit.

An Accepted Tester earns the benefit by completing every safely applicable step of the assigned plan in good faith and returning the requested results by the agreed date. Promptly reporting a required safety stop counts for any step the stop prevents. Bugs, negative findings, or a model failing qualification do not forfeit the benefit. If Smart Breeze ends an active assignment after the tester begins and returns requested work, Smart Breeze will treat the assignment as complete unless it ended because of the tester’s material breach of these terms.

The benefit is one complimentary, perpetual, non-transferable personal license for Smart Breeze’s first generally available paid major macOS release, including updates ordinarily included with that release. It excludes separately priced future major upgrades and services, is limited to one per person, and has no resale or cash value. Smart Breeze will send redemption instructions to the verified program email within 30 days after the later of completion confirmation or paid-license availability. If Smart Breeze never releases a paid version, there is no cash substitute.

Terms acknowledgement version 7 does not cancel or narrow reward eligibility already offered under versions 4, 5, or 6. Version 4 remains available to Accepted Testers in its fan-control qualification program; versions 5 through 7 extend the same completion-based benefit to Accepted Testers in either current testing track. Versions 1 through 3 remain readable as archived consent records but are not retroactively enrolled in the reward.

Private interface and responsibility

Smart Breeze uses Apple’s private AppleSMC interface. Apple does not publish or support this fan-control API, and Smart Breeze is not affiliated with, authorized by, or endorsed by Apple. The software does not guarantee lower temperatures, improved performance, hardware longevity, or protection from data loss or equipment failure.

Keep System selected unless you intentionally want additional cooling. Manual fan control is intended for diagnostics. You are responsible for monitoring your Mac, keeping backups, and stopping use if Smart Breeze reports that ownership or System handoff cannot be verified.

Beta warranty

To the fullest extent permitted by applicable law, this beta is provided without warranties. Nothing in these terms limits rights that cannot legally be waived.
